It is difficult to prove that someone gave you kmz, so maybe this is the reason why he doesn't have a ban. However it's easy to see when someone gave it to me. I ban it when there's more than enough. Something else is when a player shoots from a longer distance and blows up near you.

buke im not kmzed u u see in chat maresak killed catalina sow how i kmzed u if im dead + maresak when he kmz me why u dnt ban him ?

As you can see i killed Maresak and than you made a kmz when you was before my front bumper. Maresak was afk in that time so he couldn't shot you (maybe yes) however, you had shot me and than you died by a shockwave.
He had a "free skill"
